Terms
1. Turnaround Time
• Standard Delivery: Photo and 3D tour delivery is within 1 business day of the scheduled photoshoot. • Weekend Policy: Saturday appointments will be delivered by Monday morning. • Reel Videos: Delivered within 1–2 business days after the shoot.
2. Copyright & Usage Rights
• Ownership: Joshua J Williams Imagery LLC retains full copyright to all images and media. • License: Clients are granted a limited-use license for marketing the property only while they actively represent the listing. • Restrictions: Media may not be reused, resold, transferred, or used for future listings without written permission.
3. Short-Term Rental & Commercial Use
• Restricted Use: Media may not be used for short-term rental platforms (Airbnb, Vrbo, Flipkey, etc.) without a commercial license. • Commercial License: A signed commercial copyright agreement and additional fee are required for all short-term rental or commercial marketing use.
4. Domain Name Policy
• Non-Refundable: Domain name purchases are non-refundable once the custom URL has been created and delivered.
5. Reshoot Policy
• Reshoot Fee: A $50 reshoot fee applies if the property needs to be reshot due to changes made after the original shoot (e.g., staging, cleaning, landscaping). • Non-Error Reshoots: Reshoots requested for reasons unrelated to photographer error will also incur this fee.
6. Cancellation & No-Show Policy
• Late Cancellation: Appointments canceled within 1 hour of the scheduled shoot time may be subject to a $50 cancellation fee. • No-Show: If the photographer arrives and is unable to access or shoot due to the property not being ready or no one being present, a $50 no-show fee may apply.
7. Weather Policy
• Proceeding with Shoots: Sessions will continue during light weather conditions (cloudy/overcast), unless otherwise requested. • Severe Weather: If poor weather is expected (e.g., heavy rain, strong winds), clients may reschedule at no additional cost.
8. MLS & Marketing Compliance
• Property Lines: Outlined property lines are for visual reference only and may not reflect exact lot boundaries. Always verify with official property records or survey documents. • Virtual Enhancements: Photos edited with virtual staging or enhancements must be disclosed in the MLS listing per most local board rules. It is the agent’s responsibility to remain in compliance with MLS policies.
