TERMS OF SERVICE

1. Turnaround Time

Standard Delivery: Photos and 3D tours are delivered within 1 business day after the shoot.

Weekend Policy: Saturday shoots are delivered by Monday morning.

Reel Videos: Delivered within 1-2 business days.


2. Copyright and Usage Rights

Ownership: Joshua J Williams Imagery LLC retains full copyright and ownership of all photos, videos, and other media created.

License: Clients are granted a limited, non-transferable license to use the delivered media for marketing the property for which the media was originally commissioned while the listing is actively being marketed.

Alterations: Delivered media may not be materially altered, retouched, AI-modified, manipulated, or used to create derivative images without prior permission from Joshua J Williams Imagery LLC.

Permitted Marketing Changes: Standard cropping, resizing, text overlays, logos, and placement within marketing materials are permitted as long as they do not materially alter the appearance of the property or the content of the original media.

Property Accuracy: Clients may not use editing software, AI tools, or other methods to add, remove, replace, or materially change permanent property features, views, conditions, signage, addresses, house numbers, or other property details without prior permission.

Restrictions: Media may not be reused, resold, transferred, sublicensed, or used to market another property without permission from Joshua J Williams Imagery LLC.


3. Short-Term Rental and Commercial Use

Restricted Use: Media may not be used for Airbnb, Vrbo, short-term rentals, long-term rental advertising, commercial advertising, or other commercial purposes outside of marketing the original property listing without approval.

Commercial License: A separate agreement and fee may be required for commercial, rental, or other extended usage.


4. Domain Name Policy

Non-Refundable: Domain purchases are non-refundable once the custom URL has been created.


5. Reshoot Policy

Partial Reshoots: If only part of the property needs to be reshot because of cleaning, staging, landscaping, repairs, homeowner changes, or other conditions that occurred after the original shoot, a $50 reshoot fee applies.

Full Reshoots: If the entire property needs to be reshot for reasons not caused by photographer error, the reshoot will be billed as a new shoot at the current package price.

Photographer Error: Reshoots required because of an error by Joshua J Williams Imagery LLC will be corrected at no additional charge.


6. Cancellation and No-Show Policy

Late Cancellation: Cancellations made within 1 hour of the scheduled shoot may be charged a $50 cancellation fee.

No-Show or Inaccessible Property: If the property is not ready, cannot be accessed, or the photographer is unable to complete the scheduled shoot upon arrival for reasons outside of the photographer's control, a $50 fee may apply.

Rescheduling: Additional fees may apply if a return visit is required.


7. Weather Policy

Standard Conditions: Shoots will proceed during normal weather conditions, including cloudy or overcast conditions, unless otherwise requested.

Severe Weather: If weather conditions prevent the shoot from being completed safely or professionally, including heavy rain, high winds, or unsafe drone conditions, the shoot may be rescheduled at no additional charge.

Drone Operations: All drone operations are subject to applicable FAA regulations, airspace restrictions, weather conditions, and the professional judgment of the remote pilot. Drone services will not be performed when the photographer determines that the flight cannot be conducted safely or legally.


8. MLS and Marketing Compliance

Property Lines: Any property lines, boundary lines, or lot outlines shown in delivered media are for visual reference only and may not represent exact legal property boundaries. Clients are responsible for verifying property boundaries through official records.

Virtual Edits: Virtually staged, virtually renovated, AI-enhanced, virtual twilight, or otherwise digitally modified images must be used and disclosed in accordance with applicable MLS rules and advertising requirements.

Client Responsibility: The client is responsible for ensuring that all media and marketing materials comply with applicable MLS rules, brokerage policies, advertising requirements, and other applicable regulations.

Third-Party Alterations: Joshua J Williams Imagery LLC is not responsible for inaccuracies, misrepresentations, or other changes introduced to delivered media by the client or any third party after delivery.


9. Travel Fee Policy

Travel Fee: A $25 travel fee applies to North Las Vegas, eastern Las Vegas, Henderson, Boulder City, and Beatty.

Extended Travel: Locations outside normal service areas may require a custom travel quote. Any applicable travel fee will be communicated before the shoot whenever possible.


10. Same-Day Delivery Policy

Availability: Same-day delivery applies to standard photo packages only and must be selected at the time of booking.

Exclusions: Add-ons such as virtual staging, virtual twilight images, floor plans, 3D tours, video, reels, and other specialty services are not included in standard same-day delivery.

Timing: Same-day delivery is subject to availability, shoot size, scheduling, travel time, and workload.

Later Shoots: Later appointments or larger jobs may be delivered the following morning even when same-day delivery has been requested.


11. Media Delivery and Archiving

Delivery: Final media will be delivered through the designated online delivery platform.

Archiving: Joshua J Williams Imagery LLC does not guarantee permanent storage of completed media. Clients are responsible for downloading and retaining any media they wish to keep.


12. Acceptance of Terms

By booking services with Joshua J Williams Imagery LLC, the client acknowledges and agrees to these Terms of Service.

Payment for services and use or download of delivered media also constitutes acceptance of the applicable usage and licensing terms.
